  • Access to the Website

By accessing and/or using this Website, every physical person (hereinafter “the User” or “the Users”) represents and warrants that she/he acknowledges the present terms of use, legal notice, relevant rules related to the personal data, and that she/he accepts the terms and conditions without any reservations, modifications or limitations.

We reserve the right to modify them at any time, so we invite the Users to refer regularly to them.

Any modification or additional content which is included into this Website will be subject to the conditions presently set forth.

The Users acknowledge being entitled to and having the necessary means to access and use the Website. They acknowledge having checked that the computer system used contains no viruses and is in a perfect operating condition.

Bmax reserves the right, at any moment to modify, interrupt temporarily or definitely all or part of the Website without notice to the User. Bmax shall not be liable in that respect.

Bmax does not guarantee that the Website will be accessible continuously.

 

  • Privacy statements / Personal data protection

Bmax is the data controller and respects the rules related to personal data protection, including the Law of 2 August 2002 on the Protection of Persons with regard to the Processing of Personal Data, as modified.

The Users’ e-mail address, the IP addresses (Internet Protocol) related to their Internet connection and any other personal data used by the Users in order to identify themselves in an identification form following a request for documentation, a newsletter sign-up, an e-mail sent to Bmax, are the only personal data which may be collected from this Website, and processed by Bmax. The other personal data are optional and provided by the Users on a voluntary basis.

The Users are informed that the information they provide, in particular through the forms on the Website, is necessary in order to reply to their request and is intended only for Bmax, as the data controller, for administrative and commercial purposes only.

The personal data collected and processed by Bmax through its Website may not be sold or rented to third parties, against a fee or for free. Are not considered as third parties, the companies established in European Union which are part of the group to which Bmax is part of, and, in particular, the companies which (i) control directly or indirectly Bmax, and/or (ii) are controlled directly or indirectly by Bmax, and/or (iii) are directly or indirectly controlled by a company which controls directly or indirectly Bmax (hereinafter “Bmax group”).

The data controller who is processing personal data is Bmax, for its own needs and its own account and the account of companies of the Bmax group.

The Users are informed that they have a right of information, access and opposition, and that once they prove their identity, have the right to ask the data controller, as the case may be, the amendment, completion, updating, blocking, deleting of all personal data concerning them which are inaccurate, incomplete, ambiguous, expired, or which the data collection, use, communication or storage is forbidden, by writing to the data controller by email to the following address: webmaster@bmax.fr.

The Users are also aware that, while visiting the Website, a cookie can automatically be installed on their browser, this cookie only being intended to record information relating to the Internaut’s web browsing on the Website and therefore to improve its quality.

 

  • Intellectual Property – Copyright

The Website and all the elements composing the Website (logos, trademarks, files available for download, brochures, drawings, graphical representations, etc…) are the property of Bmax, which Bmax holds at least the economic rights of.

These elements are protected by national laws and international laws relating to respect of copyright, trademark, design and patent rights.

The posting of this Website does not imply license to use the proprietary rights listed above, such use is subject to the prior written consent of the owner.

The Users are not entitled to reproduce, represent, modify, translate and/or adapt, partly or wholly, against a fee or for free, the Website and each of its components, without the prior written consent of Bmax.

However, Bmax allows the Users to download the newsletters or any other document, property of Bmax, present on the Website and made available as an electronic file specifically for downloading purposes. These files are only downloadable from the hypertext link with a statement such as “download” or any other written statement giving authorization to Users to download these files. In this case, unless otherwise expressly provided and mentioned on each of the above documents, the Users will be allowed to keep a copy of these documents and to print these documents for private use.

The Users undertake not to use the Website only for private use.

Bmax reserves the right to modify or correct the content of the Website at any time without notice.

Bmax does not guarantee the accuracy, completeness or timeliness of the information published on its Website. Accordingly, the Users agree to use this information under its exclusive liability.

The Users of the Website are not authorized to establish a hypertext link directed to the Website without the express prior consent of Bmax. If they wish to do so, they must file a request at the following address: webmaster@bmax.fr.

Each User is solely responsible for the use made of the information provided from the Website. Bmax cannot be held, in any case, liable for any direct or indirect damage following the use of this information by the User.

Bmax cannot be held liable in particular in case of contamination of User’s equipment resulting from the dissemination of a virus or other computer infection. The Users shall take all necessary steps to protect their own data and/or software from contamination by potential viruses circulating on the Internet.

In any case, Bmax, the Bmax group, or their employees will not be held liable under an action in contractual liability, tort or any other action, of any direct or indirect damage, incidental or accessory, of whatever nature or for any prejudice, particularly of a financial nature, resulting from the use of the Website or any information obtained from the Website.

The Website may contain links to the websites of Bmax’ partners or of third parties. The Website is governed by the Luxemburg law.

All disputes that may arise from the use of the Website go to the exclusive jurisdiction of Luxemburg.
